How does the liability waiver work?

A standard waiver and release of liability is required for all participants.  A parent or guardian must complete a liability release for persons under 19 years of age.

We do our best to ensure the safety and enjoyment of all participants, but since these activities involve known and unknown risks, we require all guests to sign the release agreement, assumption of risk statement and liability waiver prior to departure. Waivers are available prior to making your reservation. We advise clients to arrange proper liability and medical insurance, which may include helicopter evacuation.

Guests under the age of 19 must have a parent or legal guardian sign the waiver on their behalf.

Adventure sport activities involve many risks, dangers and hazards. These risks and hazards are outlined in our release of liability waiver which participants are required to sign before participating in an Adventure Sport Activity. This agreement will affect your legal rights should you be involved in an accident.

Do you need a damage deposit?

Yes

A valid Visa, or MasterCard is required for a damage deposit, card will be charged an amount of $2500 per incident.  A credit card with valid photo ID on file as a damage deposit required for all adventures.  Without a valid credit card or if we are unable to process the pre-authorization on your credit card, you will not be able to proceed with your booking.  No refunds on day of booking due to invalid credit card pre-authorization.  Please bring a valid credit card with you.  Please note Visa Debit/Mastercard Debit cards are not accepted in Canada as credit cards.

Am I liable for any damages?

You are liable for the total amount (including taxes) for any damages to the machine per incident. A damage deposit hold of $2500 is required for each vehicle. Your deposit will be released once your tour/rental concludes and no damages are reported.

Damages are quite unfortunate, and we share your dislike for them. When damages occur, you bear the cost, which is often avoidable. We face loss of value on our machine, downtime when it can’t be rented out, and the extra work of sourcing and installing replacement parts. It truly is a lose-lose situation. We prefer to avoid disputes over damages with our guests. Similar to a car, cosmetic damages, parts, and labor costs can accumulate rapidly. Certain damages, such as those to the front end and frame, may not be fully evaluated until we, or a dealer, disassemble the machine. Our procedures clearly state that you are responsible for all damages. If you have any questions before taking out a machine, please ask.

Damages are assessed on a per-incident basis; this means if you cause damage on one day, you will be responsible for those costs. If your rental machine becomes inoperable due to damages you cause, you are not entitled to a refund. However, we will strive to provide you with a replacement machine if one is available. In cases of damage resulting from reckless driving, we will terminate the remainder of your booking without a refund. Damages will be charged to the pre-authorization provided for the damage deposit within three days of the incident.

It’s in your best interest to thoroughly check your machine before departing for your tour. We will conduct a detailed walkthrough with you and advise you to note all existing damages, which will be documented in your contract and captured in a video prior to your rental. We encourage you to take this process seriously. Upon return, we will inspect the vehicle with you and assess any damage. All damages are subject to a final review by our repair facility.

You will incur charges for the following types of damages:

Parts: Replacement cost of parts, including labor and any shipping fees.

Frame Damage: Full cost of damages, which may include the entire vehicle cost if not repairable.

Scratches: 50% of the part cost for scratches, while cracks will incur the full cost of part replacement.

Safety Equipment:  Replacement cost of damages to helmets, goggles, gloves, etc.

If you disagree with our damage assessment, we are happy to arrange for an evaluation by a dealer.

What is the minimum age required to operate an ATV?

Proof of ID is required, minimum age is 19 years old, a valid class 5 unrestricted drivers license is required for all drivers

We do not have a minimum age requirement for passengers; however, children must be able to sit safely in a seat-belt, or have a car-seat that extends above the child’s head. Most car-seats can be installed in our UTVs. While we have no minimum age, for a child to ride in our UTV’s they must be able to safely wear a helmet and be safely buckled into the seat. Please contact us to verify that your child/children can safely ride with us.

Will I be riding with anyone else in my side by side?

We require a minimum of two people per side by side but they will hold up to four people.  As long as you have two people, you will have the side by side to yourself for the ride.

Can I operate the ATV, and can we alternate driving?

Yes

You drive the side by side and follow our guide.  You are more than welcome to take turns driving with anyone that is at least 19 years old and shows a valid driver’s license at check in.

Will there be any stops for breaks during the ride?

Yes

Our guides stop 2-3 times for 5-10 minutes each for everyone to stretch their legs, grab a bite to eat and snap a few pictures.  This is also a great time to switch up drivers if you choose to do so.

Are helmets required? What type of clothing should I wear?

Yes

Everyone is required to wear a helmet.

Closed toe shoes are recommended, and clothing appropriate for the current weather conditions.

We recommend wearing dark colored clothing that you don’t mind getting dirty or wet.  It’s also a great idea to wear light weight clothing that can dry easily as most people do get wet.  Some will bring a change of clothes to change into after the ride and/or towel to sit on in their vehicle for the ride home.  It can be very dusty so be prepared to get dirty.

An additional layer is recommended on cooler days to stay warm.

For best fit and comfort, we encourage you to bring your own riding gear (including helmet, gloves, goggles, boots, or shoes). Come prepared for the weather.

 

Will we end up getting dirty, dusty, or wet?

Yes

Depending on how recent it has rained will determine how dusty or wet it will be. Please check the weather forecast before you come, if it is supposed to rain, or has recently rained you may want to bring a rain coat and rain pants as it can definitely get wet.

Is prior experience with ATVs or off-road driving necessary?

No

As a matter of fact, 90% of our guests are first time drivers/riders in a side by side.  We do not do anything extreme nor do we have any big hill climbs or thick mud to get you in trouble.

No experience necessary, our UTVs are very easy to learn and drive. All guests are given a vehicle orientation and a familiarization period driving the UTV.

 

Can I bring my pet?

Bringing pets along is not recommended; however, we are always happy to discuss. Please contact us before you book to discuss accommodating your pet.

Will we see any wild animals?

Maybe

There are many animals in this area, however we can never guarantee you will see a wild animal. Most notable animals in the area include: deer, moose, bears, bobcats, mountain lions, rattlesnakes, coyotes, rabbits, eagles and hawks, among others.

Do you serve meals?

No, but custom arrangements can be made for catering meals. We also allow guests to bring along their own food or non-alcoholic beverages, we generally have extra room in our coolers.

Are restrooms available?

Restrooms are available at our main office, some remote areas on the trails have an outhouse.

What are your policies regarding reservations and payments?

Reservations are mandatory for all adventures and rentals. To secure your booking, please click on the BOOK NOW tab and complete all required information to confirm your reservation.

Full payment will be charged to your credit card at the time of booking, as we utilize a booking service for all our adventures and rentals.

Please note that the following fees are not included in our packages: 5% GST, processing fees, fuel surcharges, and gratuities.

We only accept Visa and Mastercard for payments; if you wish to book using cash, please contact us directly.

What is your policy regarding cancellations?

• Full refund if canceled more than 72 hours before the start time.

• No refunds for cancellations made within 72 hours of the start time.

• No refunds for no-shows, unused days, or early returns.

A 15% administration fee applies to all cancellations.

We recognize that unexpected circumstances may arise, preventing a guest from attending. If we can re-book your reservation before your trip or move you to another date, we will do our best to accommodate your requests. However, if you change your booking within the cancellation period, charges will still apply based on your original booking date. Please CALL AND EMAIL US if you need to cancel.

Note: Our refund policy is strict, with no exceptions. We highly recommend that all customers obtain their own travel or cancellation insurance to cover any events that might necessitate canceling your trip before arrival or disrupting it after it has started. Written cancellations should be directed to our office only. Refunds will not be issued for no-shows.

If you experience a delay, please contact us so we can hold your machine for you; otherwise, you will be considered a no-show, and your reservation will be canceled without a refund. Additionally, we strongly encourage guests to secure their own travel insurance to safeguard against potential cancellation needs. We also recommend obtaining medical and evacuation insurance. You can consult your personal insurance provider for options.

Full Cyrcle Adventures does not issue refunds or credits for days when weather conditions are poor. Please understand that we cannot control the weather and will not provide refunds due to adverse conditions. Our policy is to operate every day, striving to ensure a fun experience and making the most of what nature offers, even in less-than-ideal circumstances. Your cooperation in this is greatly appreciated. We reserve the right to cancel any tour, in whole or in part, for various reasons, including inclement weather, terrain issues, operational emergencies, mechanical problems, pandemics, or insufficient guest bookings. We will not be liable for any liquidated damages, consequential cancellation fees, rental charges, service fees, or any other compensatory charges.

What are my responsibilities?

It is your duty to ensure that a proper helmet is securely in place. All drivers must possess a valid driver’s license to operate our vehicles. Prior to departure, every client is required to read and sign a waiver of liability. A valid driver’s license must be shown at the start of each tour. Additionally, all clients must have their own medical and liability insurance. Please be aware that your travel insurance should cover extraction from remote locations.

 

What happens if I accidentally damage or misplace my personal belongings?

Full Cyrcle Adventures is not liable for any loss or damage to property left on the premises or in, on, or carried by the rental equipment. Additionally, we do not take responsibility for theft or damage to your vehicle or personal items during our tours. Please make sure to lock your vehicle before you leave.

What is my liability risk?

We strive to guarantee the safety and enjoyment of all participants. However, since these activities come with both known and unknown risks, we ask all guests to complete a registration form, an assumption of risk statement, and a liability waiver before embarking on your tour. Waivers can be obtained prior to making your reservation. We recommend that clients secure appropriate liability and medical insurance, which may encompass helicopter evacuation.
